Vehicular Manslaughter
Vehicular manslaughter is a very serious charge that is usually the result of drunk driving, road racing or road rage. However, it can also result from alleged misuse of recreational vehicles like ATVs or sand rails too. Under Oregon law, there are three vehicular manslaughter charges:
Manslaughter in the first degree — When the driver acted recklessly with an extreme indifference to the value of human life and caused death
Manslaughter in the second degree — When the driver acted recklessly and caused death
Criminally negligent homicide — When the driver was criminally negligent and caused death
Manslaughter in the first degree and second degree are Ballot Measure 11 offenses. Conviction carries mandatory prison time with no opportunity for parole. While there is no mandatory time for criminally negligent homicide, if you are convicted on that charge, there is a high probability that you will serve time in jail.
